These terms govern your use of Respite, a migraine diary for iPhone published by MPC Digital Ltd. By downloading or using the app you agree to them.

The short version. Respite is a diary, not a medical device — never make a treatment decision on the strength of what it shows you. Every feature is free: there is no subscription, no in-app purchase and no advertising. Your record stays on your device, and it is yours.
Respite is a personal record-keeping app. It is not a medical device, and it does not provide medical advice, diagnosis, prognosis, prediction or treatment recommendations.
Everything Respite displays — trends, counts, averages, per-dose summaries and the exported report — is a descriptive summary of data you entered. It is not validated clinical output, and the app does not interpret it on your behalf. Respite will not tell you that an attack is coming, that you have a particular condition, or that you should take, change or stop any medication.
Always consult a qualified healthcare professional about your symptoms, your medication and any decision about your care. Never delay seeking medical advice because of something you saw in this app. If you think you are experiencing a medical emergency, contact your local emergency services.
You own the data you enter. It is stored on your device, and MPC Digital Ltd neither receives nor holds it. We claim no rights over it and cannot access, restore or recover it.
Because there is no cloud backup, keeping your own copy is your responsibility. Use the export or encrypted backup feature if you want one. We cannot recover a record lost to a deleted app, a lost or reset device, or a device restore that does not carry it across.
Subject to these terms and to Apple's Licensed Application End User Licence Agreement, MPC Digital Ltd grants you a personal, non-exclusive, non-transferable licence to use Respite on Apple devices you own or control. You may not copy, modify, reverse-engineer, redistribute or resell the app except to the extent that applicable law expressly permits it.
Respite is free of charge in full. Every feature — logging, the intensity trend, the per-dose medication view, the doctor-report PDF, the sleep and cycle correlations, the encrypted backup, the widgets and on-device storage — is provided at no cost. There is no subscription, no in-app purchase and no advertising, and nothing you log is ever locked behind a payment. Respite does not sell or share your data; that is not how it is funded.
Respite is for your own personal record-keeping. Do not use it to record data about another person without their knowledge and agreement, and do not use it in any way that breaks the law.
We may update Respite to fix problems, improve it or keep it compatible with new versions of iOS. Features may change over time; the commitment in section 4 that the app is free is one we intend to hold to. We may stop distributing the app, but if we do, the copy already installed on your device continues to work and your record stays where it is.
Respite is provided “as is”. To the fullest extent permitted by law, MPC Digital Ltd excludes all implied warranties and is not liable for indirect or consequential loss, or for loss of data, arising from your use of the app.
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Your statutory rights as a consumer are unaffected.
Apple is not a party to these terms and has no responsibility for the app or its content. Apple is, however, a third-party beneficiary of these terms and may enforce them against you. Any claim relating to the app should be directed to us, not to Apple.
These terms are governed by the laws of England and Wales. If you are a consumer, you keep the benefit of any mandatory protections of the law of the country in which you live, and you may bring proceedings in the courts there.
